The Claim:

The Real Story:
In addition to imposing voter approval requirements for commercial property 25,000 square feet or larger, Measure R amends the Community Plan by deleting two specific objectives relating to mixed residential-commercial land uses. These amendments do not relate to the proposed Watermark Project.

Council Candidates Forum
6-7:30 p.m. | Thursday, Oct. 20 | Powerhouse
The Del Mar Times is hosting its Del Mar City Council Candidates Forum from 6-7:30 p.m. on Thursday, Oct. 20 at the Powerhouse Community Center in Del Mar. Former award-winning NBC San Diego news anchor Susan Taylor, who has served as director of external affairs at Scripps Health since 2012, will moderate the event.  All six candidates for the office of Del Mar City Council have been invited. Attendees will have an opportunity during the forum to submit questions for the candidates.

  I hope that by now those who have loudly asserted that rentals under 30 days are illegal and contra to the community plan, are aware of the zoning code sections, community plan language, and that has been common practice since well before Del Mar was a city for owners of beach area [west of the railroad] homes to rent them [while owners were away] to other families for summer vacations, usually of a week or more.   If you still doubt this long standing practice talk to Tom Pearson, Chiquita Abbott, or Joe Jelley; or read Laura deMarco’s red dot letter last tuesday to the Council..].  If you doubt the legality, talk to the city attorney or any attorney expert in statutory construction.  But let’s look forward, not back, to decide what to do in the future.

The complaints have been directed at a large increase recently of the number of rentals to vacationers leaving fewer full time residents [especially in some beach areas], about homes are being purchased by persons now using them as a “business”, using these homes as full time vacation rentals of any number of nights to vacationers, and about severe overcrowding and problems with parking, trash, noise at these rentals that changed occupants every few days. In some of these full time vacation rental homes, no one ever resided in these homes.   I agree that homes in residential zones should be used primarily as homes of Del Mar residents, not as an income producing investment earning rent from year round vacation rentals.  But I believe that prohibition of all vacation rentals [under about 30 nights, called “STRs”] is not fair to long term, full time residents like me who need to rent our homes for a couple months each year to help us afford to remain in increasingly expensive Del Mar.

COMPROMISE SUGGESTIONS:   Resident homeowners like me should be allowed to make minimum one week [6 night min] rentals to vacationers “in the summer” [from fair, through summer racing].  To prevent other problems:  Parking should be only onsite of all vehicles driven by vacationers.  Overnight occupants should be limited to 2 per bedroom [rooms designed/regularly used as bedrooms].  Require compliance with normal city requirements for noise and trash. [I assume Del Mar has standards applicable to everyone.]        

I would provide enforcement leverage by requiring before each vacation rental:  A written list of legal requirements [and good neighbor policies?], identification of all persons staying overnight, vehicles driven by tenants and a deposit  which may be used [paid to city or otherwise used] if these requirements are violated [perhaps the same deposit normally made for possible damages of premises by tenants]... which deposit should deter the prohibited bad tenant actions. Enforce these, not by a city bureaucracy but through a volunteer organization that I would be willing to join.

The Council indicated on Oct 17, that it had been considering solutions in its’ non public meetings and wanted to complete its new STR requirements  early in 2017.  So all of us with ideas how to reach a reasonable compromise benefitting all Delmartians should red dot or otherwise make them known to city officials, staff and to residents who want to participate.  If we all contribute with a spirit of friendship and consideration of the needs of all permanent Del Mar residents we shouild find a compromise that serves all.   
Channel 10 was asked by an anonymous group and City Council Candidate T. Pat Stubbs to investigate the Del Mar Sandpiper for campaign violations, apparently because the Sandpiper did not endorse his candidacy. 

As a 501(c)(4) organization it is fully within the rights of the Sandpiper to advocate political positions.  The Sandpiper has existed as a monthly journal for almost 20 years with the mission of promoting the values of Del Mar that have made it such a desirable place to live.  The Sandpiper covers many aspects of the city and its residents, a small percentage of which are editorials and opinion pieces which promote positions on issues that the editors feel are in line with community values. Not everyone may agree with these positions, so we solicit opposing views, including a "Pipe-up" feature to air differences. 

In the current election, the Sandpiper offered space to all candidates to present their qualifications and to answer a set of questions about current issues. The editors decided it would be in the community's interest to voice the Sandpiper's views about the six candidates who are running. Of course, under the First Amendment, the Sandpiper has the right to express its views, just as many others in the community are doing.

This is the first contested election for Council in 10 years, and a lot is at stake for the community in who next serves.  The editors came to a consensus about which candidates would do the most for Del Mar to promote the Community Plan and keep Del Mar from losing its unique character.  The rationale for those choices is given in the paper.  Perhaps Stubbs and two other candidates were disappointed not to be endorsed. But making an unfounded accusation against the press, whether in Del Mar or nationally, is a political ploy that gets air time but does not advance civic discourse.

We are encouraged that most of the candidates are focusing on issues important to citizens of Del Mar.
Cory Briggs Threatens Lawsuit against Del Mar over Measure R

As you know, the November ballot in Del Mar will have a citizens initiative, Measure R, for voters to decide.  If approved, Measure R would require a public vote before the approval of any significant projects affecting any commercial zone in the City can be pursued.

At the League of Women Voters Forum on Measure R, held at Del Mar City Hall on October 5th, Bud Emerson and I spoke in opposition to Measure R.  I pointed out that Measure R specifically would impede Del Mar's ability to carry out legal mandates imposed by the State for approval of affordable housing projects.  

The proponents of Measure R defended the initiative against our claims that it would conflict several legal mandates by asserting the initiative is legally correct.

This morning [Oct. 15], the Voice of San Diego website carried an article in which it is revealed that Cory Briggs, a prominent San Diego Attorney whose practice involves public interest lawsuits against public agencies, sent a letter to the Del Mar City Manager, dated June 27, 2016, which threatens to bring a lawsuit against Del Mar if the City does not move with deliberate speed and effort toward meeting the State's mandate for zoning and approval of its regional affordable housing allocation. The letter specifically mentions the property in Del Mar that is the subject of the proposed Watermark project. It is the Measure R proponents' opposition to this very same project that motivated them to promote the initiative.

Setting aside any legal advice the City of Del Mar has received from its attorneys on the letter, I believe the letter itself is a matter of public interest and should receive public attention and discussion in the run up to the November election.  It confirms the assertions I and others have made that the approval of Measure R will subject the City to lengthy and expensive litigation. 

Accordingly, I will appear at the Del Mar Council Meeting this Monday, October 17, 6PM, under Oral Communications, to request the City Council schedule the matter for public discussion at the next available Council meeting. 

Sandpiper Endorses
San Diego Union School District

Joyce Dalessandro and Beth Hergesheimer

For the Del Mar Union Elementary School District (K-6th) the Sandpiper endorses the two incumbent Board members running for re-election, Erica Halpern and Darren Gretler. Our elementary schools (Del Mar Hills, Del Mar Heights, and six schools in Carmel Valley) are providing an excellent education with children testing in the top 1% statewide, and these School Board members can take some of the credit.

For the San Dieguito Union High School District (7th-12th) the Sandpiper endorses the two incumbent Board members running for re-election, Joyce Dalessandro and Beth Hergesheimer.

The outcome of the High School District election is particularly important. Along with Amy Herman, Dalessandro and Hergesheimer have consistently carried the day, in 3-2 votes, supporting our very successful academic programs and staff. Although the boards are supposed to be non-partisan, the two negative votes have regularly come from  board members who have created a contentious atmosphere leading some administrators to leave.  Both of these board members have endorsed two of Dalessandro and Hergesheimer’s opponents, hoping to take control of the school district. One of the opponents, whose children attended private schools, is endorsed on his website by the San Diego Tea Party, the California Christian Coalition and the Minutemen. Election of the opponents of Dalessandro and Hergesheimer would tip the balance and lead to disaster for our middle schools and high schools.

In response to a recent law enforcement campaign by North County Transit District to enforce “no trespassing” laws against pedestrians crossing the railroad tracks in Del Mar, all Council members and candidates have stated support for providing a legal pedestrian crossing on the Del Mar bluffs, and for removing the tracks from the bluffs sooner than currently planned. The bluffs are a sensitive coastal feature, and the LA-San Diego rail corridor is the second busiest in the U.S., with 50+ trains per day.

Providing a legal rail crossing on the Del Mar bluffs will be a huge challenge. There are
serious questions about whether one acceptable to the community can be approved at all, and 2 years is a demonstrably unrealistic timeline. Federal and California Public Utilities Commission (CPUC) policies and regulations, and recent experiences in Encinitas and San Clemente, demonstrate the legal and technical complexity of these crossings. Given the authority of the federal agencies and the CPUC, this is not a
problem that can be solved by “going to our state legislature.”

Downtown Revitalization

Since Measure B applies to only 3 parcels based on lot size, all of which have voter-approved plans, it is not responsible for blocking downtown development. Notable projects have been developed post-Measure B, and the City has made significant public investments in downtown improvements and promotion.
Ultimately, property owners decide how to use their commercial properties, and the Del Mar Plaza’s underperforming status reflects that fact, with overseas owners and nonlocal representatives responsible for business decisions that have resulted in the Plaza’s current state.

The Garden Project “absolutely got beat up when it came to this town; it was voter-approved, but it was so watered down by the time that the voters got to it by the powers that be that the banks didn’t want to touch it.”

The Garden Project was approved by the City in a form acceptable to the developers and the community, with an 84.5% public vote of approval in Nov. 2008; it was derailed not by any action by the City, but by the largest economic downturn since the Great Depression.

Serious Tax Consequence
if you change your voter registration
to rental property

FYI - there is also a serious tax consequence for the non-residents changing their voter registration to their rental property.  The IRS requires that an owner not use rental property for their own purposes for more than 10% of the tax year.  Otherwise they lose the rental tax write-off.

I am not an attorney (thank God ;-) and not a tax person, but have to answer this question every year on my 1040 for a time share that I own and rent out.

Stu Smith Jerry Winterer

Two local explorers of ocean floors throughout the world and participants in numerous scientific expeditions with Scripps Institute of Oceanography (SIO) passed away in the last month.

Edward (Jerry) Winterer, professor emeritus of geology and renowned expert in the study of sediments that cover the world’s sea floors, leading seven “Deep Sea Drilling Project” expeditions, passed away at his home on August 30. He was 91 years old. His wife Jacqueline Winterer, also a recognized research geologist and Del Mar leader, followed Jerry to Scripps from Belgium where they had met in 1960 during his Fulbright Fellowship at the University of Louvain.

Stuart Smith, a specialist in submarine geology at Scripps and head of the Geological Data Center which archived marine data from Scripps vessels, died on September 4 at the Encinitas Nursing and Rehabilitation Center. He was 80 years old. Stu was active on the Friends of the San Dieguito River Valley Board and as a hiker and photographer of valley landscapes. STRs: What are the goals?

I sympathize with Scott Renner’s views on short-term rentals published in The Sandpiper on September 21. The issue has been discussed extensively in workshops and Council Meetings and has been the subject of numerous letters to the Council. I believe Council inaction is due to the fact that while there is a consensus on the part of the Council that a problem exists, there is no agreement as to what the ultimate goal is. If it is to minimize the nuisance effects of short-term rentals such as noise, shortage of parking spaces, and littering, then effective regulation—to the extent regulation can be successful--is important. But if the goal is to maintain and enhance the “fabric” of neighborhoods and lessen the “intensity” of home use, regulation is not nearly as important as adhering to the spirit and, I would argue, the letter of the Community Plan and enforcing a ban on short-term rentals. This will more effectively deal with noise, parking, and trash issues.

I’m skeptical that this Council, despite the good will and collaboration among Council members that appear to exist, can come to a fundamental agreement as to goals. The Council election in November may serve as a referendum as to what the greater Del Mar community wants and allow the new Council to more effectively address the issue. I suspect, however, that on an issue of this significance, a community vote will be necessary. In the interim, I question the value of further discussion by this Council and the expenditure of taxpayer funds to obtain more information.

Why I am for Measure Q

There are lots of good reasons to support the 1% tax increase but here is one that has to do with safety.

Many years ago an utility wire fell on one of our stately palm trees on Crest Road and started a fire. The fire was quickly extinguished but if this had happened during Santa Ana wind conditions, it could have become a serious fire situation for homes down the hill. Undergrounding the utility wires will make us all safer from fires.

Yes, undergrounding will increase the value of our homes, and yes it will enhance the beauty of our roads, but even more importantly, it will make us safer from fires.

I urge a vote YES for Measure Q

Farmers Do Good

The Del Mar Farmers Market is proud to announce its scholarship recipients for 2016. Paul Schaner and Timothy Sheehy, both of Schaner Farms, received DMFM scholarships. Paul is taking classes at Palomar College and plans to transfer to Cal Poly San Luis Obispo where he will major in Agriculture. Timothy also attends Palomar College, where he played water polo and was on the swim team. After Palomar, Timothy plans to major in Agriculture at a California State University. Also receiving a scholarship this year is Fabian Huertas, who works for Blue Heron Farms. Fabian, a full time student and a full time father, is studying Business Marketing at CSU San Marcos. The scholarship program was created in the early 1990s, in honor of Mary Maciel, one of the original farmers of the DMFM. The goal of the program is to encourage higher education for family members and employees of the farmers/vendors of the DMFM. The DMFM congratulates each of this year’s recipients
